DANIEL LIN is a partner of Sidley Austin Nishikawa Foreign Law Joint Enterprise. Daniel’s practice focuses on energy, infrastructure and M&A transactions.
Daniel regularly advises Asia-based utilities, trading companies, export credit agencies, commercial lenders and other corporations on cross-border investments and financing in energy projects and other assets throughout the world. He has counseled prominent Japanese utilities, trading companies and other corporations on cross-border investments and M&A matters in a variety of sectors, including power (both conventional and renewable) and oil and gas, and he regularly advises Asia-based financial institutions and export credit agencies on the financing of both greenfield and brownfield power and infrastructure projects. In addition, Daniel has worked in the legal department of one of the Japanese export credit agencies while on secondment.
REPRESENTATIVE MATTERS
M&A and General Corporate Representations:
• a major Japanese trading company on a partial sell-down of its interest in a greenfield power project in the United States;
• a number of Japanese utilities and trading companies on their various investments in greenfield and brownfield power projects across North America, South America and Asia;
• a major Japanese utility on its follow-up investment in a brownfield independent water and power project in the Middle East;
• a major Japanese corporation on its investments in the financial services sector in Asia and in environmental services providers in North America;
• an Asian consortium’s bid to acquire a U.S. oil major’s geothermal assets in Indonesia and the Philippines;
Financing Representations:
• (i) Japanese commercial lenders and ECAs on financing a US$2 billion coal-fired power project in Indonesia sponsored by a Japanese trading company, and (ii) the restructuring of the same project to accommodate the project’s expansion;
• Japanese and other Asian commercial lenders on the financing of a US$3.4 billion coal-fired power project in Indonesia sponsored by Japanese and Indonesian companies;
• Japanese and Korean commercial lenders and ECAs on the financing of a coal-fired power project in Indonesia sponsored by Japanese, Korean and Indonesian companies.
